Probate Proceedings I represent clients in probate proceedings – whether as heirs, persons entitled to a compulsory portion, or beneficiaries under a will. I assist with filing declarations of inheritance, administering the estate, and dividing the inheritance. Where tax-related issues arise in the context of succession, I coordinate closely with your tax advisor. Disputes over inheritance I advise and represent clients in asserting or defending inheritance and compulsory share claims. This includes disputes over the validity of wills, reductions of compulsory portions, legacies, and lifetime gifts made in advance. I also assist in cases involving contested wills or gifts – for example, where questions arise about testamentary capacity or other legal concerns. Cross-Border Inheritance Cases I also represent clients in inheritance cases with international aspects. Such cases may involve heirs living abroad or assets located outside Austria, such as real estate or bank accounts. However, the costs of legal services often cannot be precisely quantified in advance — some factors only become apparent over the course of the case. Depending on the case, I offer different billing models: Fees according to the Austrian Lawyer's Fees Act In civil proceedings with average complexity, I generally charge according to the Austrian Lawyer's Fees Act. The fee depends on the value in dispute and the specific course of the proceedings. Hourly rate For more complex or individual matters — such as corporate law, IT-law, inheritance law, administrative proceedings, or some civil proceedings — I charge based on an hourly rate. The hourly rate will be agreed upon with you in advance. Fixed fee When drafting real estate contracts, I generally charge a fixed fee, usually a percentage of the purchase price. The amount of the fixed fee depends on the scope of the activities and any additional necessities (e.g. the need to obtain approval for the transaction from the land transfer authorities [German: Grundverkehrsbehörde] or the probate court [German: Verlassenschaftsgericht]).
